There may be times when your data is passed to me and held by me in carrying out my work on your behalf.

 

I only use your personal data, where it is needed, to perform the professional services you engage me in.

 

I do not share your data with any third parties outside of our contractual agreements save where required to do so by law.

 

I only plan to use your data to carry out my professional services on your behalf and at your request.

 

The name of my business is Alex Hare Photography and I am the person responsible for your data.

 

I hold your data as supplied to me by you for the periods specified by the statute of limitations. In practical terms this is currently 6 years.

 

You can request a copy of the data I hold for the purposes of amending, correcting or deletion by contacting me on my email address: alex@alexharephotography.com

 

If you wish to complain abut how I carry out my data and GDPR obligations, you may do so by contacting the Information Commissioners office.

 

Terms and Conditions of Business

 

The following terms and conditions govern the supply of all goods and services offered by Alex Hare, trading as Alex Hare Photography. Once an agreement for the supply of any goods or services is made you are deemed to accept these terms and conditions which shall govern this agreement. Any dispute shall be subject to the Law of England and Wales.

 

References to 'I' and ‘we’ and 'me' and 'Alex Hare' refer to Alex Hare Photography.

References to 'you' and 'your' refer to anyone who engages or receives the goods or services of Alex Hare Photography.

 

Changes to These Terms

These terms and conditions may be varied at any time by amending this page.

This website may be updated from time to time and may the content may change at any time. Please note that any of the content on this website may be out of date at any given time and we are under no obligation to update it.

Alex Hare does not guarantee that this website, or any content on it, will be free from errors or omissions.

Accessing this website

Unless any content is paid for this website is made available free of charge.

Alex Hare does not guarantee that the website, or any content on it, will always be available or be uninterrupted. Access to the website is permitted on a temporary basis. Alex Hare may suspend, withdraw, discontinue or change all or any part of this website without notice. Alex Hare will not be liable to you if for any reason the website is unavailable at any time or for any period.

Where content has been paid for and this website cannot be used to access it Alex Hare may make any content paid for by any individual available for download in full and final satisfaction of any liability in this regard.

You are responsible for making all arrangements necessary for you to have access to this website.

Alex Hare is the owner or the licensee of all intellectual property rights in this website and in the material published on it.  Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

If you print off, copy or download any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.  You will also forfeit your rights to any paid for content accessed via this website.

Viruses

Alex Hare does not guarantee that this website will be secure or free from bugs or viruses.

Alex Hare will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this website or to your downloading or streaming of any content on it, or on any website linked to it.

You are responsible for configuring your information technology, computer programmes and platform in order to access our site. You should use your own virus protection software.

You must not misuse this website by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.

You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately and you will forfeit any rights to any content paid for or otherwise in your account.

 

Payment Methods

 

Payments on this website are processed via PayPal. PayPal offers an industry standard secure on-line payment system and you can use any credit or debit card to pay via PayPal. You can even make payments if you do not have a Paypal account.

Packaging

 

Photographs ordered as prints will be packaged in the following ways:

 

·      Print orders will be supplied rolled and wrapped in tissue paper and then sealed inside a protective cardboard roll tube.

·      Canvas prints are supplied in bubble wrap and then boxed in strong protective cardboard.

 

Prints are made on archival, professional quality paper which I consider best reflects the quality of my images. You should still avoid placing your print near any heat source or in direct sunlight but under 'normal' conditions you can be assured that your print will stand the test of time.

 

Processing and Delivery

Print orders should be with you within 10 working days of placing an order and generally a lot sooner because they come straight to you from the professional print maker I use via their courier. If for any reason there is a delay I will contact you by email to advise and if you don't receive your print within this timescale please inform me. 

Delivery within the UK is via Royal Mail standard first class delivery and is included for all print orders.  Recorded or signed for delivery is available at your request and expense.

 

If you need a print to be sent abroad a surcharge will apply to cover the cost to your destination. If you are an international customer please contact me when you are ready to submit your order to confirm delivery costs as they vary from country to country.

 

Returns Policy

Ever effort has been made to ensure that print you receive is of the highest quality. However, if for any reason you are unsatisfied with your order please return the item(s) within 7 days of receipt. Provided the item is not damaged in any way I will be happy to offer you a choice of either a replacement, or a full refund. Postage cannot be refunded, unless the item is faulty, and the risk of item(s) remains with you at all times until they are received by me. On this basis I recommend that you return goods via recorded delivery and consider any appropriate insurance. I cannot responsibility for any item(s) that you return and which I do not receive.

 

Personal information

Upon making an order the following personal information may be stored in our records:

·      name

·      contact information including email address

·      postal addresses for shipping and billing purposes

·      credit or debit card information you supply to us

 

Your personal details will be treated in accordance with the General Data Protection Regulation.  You can read about how we handle your data under this Regulation in our Privacy Policy.

 

By placing your order you are supplying us with your personal data which, under these terms & conditions of sale, we will need to use in order to fulfil your order.  We will also store your data and we may use it to contact you in the future.  Your data will not be shared with anyone not concerned with fulfilling your orders or delivering any of our services.  If you wish to amend or withdraw your consent to any of this please use the Contact us page to inform us of your wishes.

 

It is a condition of sale that in placing an order for any of the goods or services I supply, you consent to me processing your data for the purposes of fulfilling the order you have made.  You also consent (not as a condition of sale) to my storing your data for the purpose of sending you future promotional news and information relating to Alex Hare Photography. You are welcome to contact me via email to let me know if your personal details change or if you would like to change either the data I hold about you or how I would like to process it provided it does not materially affect my ability to perform my contractual liabilities to you.

 

Workshop terms and conditions

If you are coming on a workshop please note the following terms apply.  A full set of the Workshop Terms and Conditions is annexed below as Schedule 1:

 

1.     Workshops often take place outdoors and involve walking with your camera gear so you are responsible for ensuring you are fit enough to participate. Please get in touch if you need more information about the level of walking.

2.     If you have a disability you must not be put off attending a workshop but I encourage you to contact me so we can discuss any issues you feel will help you participate.

3.     Attendance and participation in all workshops is entirely at your own risk. Alex Hare Photography cannot accept liability for any losses, claims, costs, expenses, personal injury or damage of any kind to you or your equipment and it is an express condition of your booking that responsibility for taking any appropriate insurance against these risks lies with you and/or the person(s) attending the workshop.

4.     If you have any special dietary requirements please inform me prior to booking.

5.     Unless otherwise stated food, drink, flights and travel to and from the workshop destination are not included.

6.     Alex Hare Photography reserves the right to cancel or move any workshops it advertises and arrangements will be made to move the workshop to another date. If it is not possible for you to attend an alternative date then a full refund will be made for the cost of the workshop.

The Alex Hare Photography web site contains links to sites of interest. Alex Hare Photography does not control the privacy practices of these other sites nor the content and access to them is entirely at your own risk.

DEFINITIONS

Tripod Travels: shall mean Lizzie Shepherd and/or Alex Hare or such other photographer as is appointed in place of either of them, and agreed between the parties

the Client: shall mean the person or persons listed in the Booking Form under such prefix

the Fee: shall mean the fee listed in the Booking Form payable by the Client to Tripod Travels for the purposes of the Client attending the Workshop and including any applicable VAT

the Dates: shall mean the date(s) listed in the Booking Form in respect of the commencement and conclusion date of the Workshop

the Deposit: shall mean the sum listed on the Booking Form payable by the Client to Tripod Travels

the Booking Form: shall mean the form attached to these terms and conditions and comprising the Agreement between the Client and Tripod Travels

Accommodation shall mean any room for single or double occupancy (as may be required by the Client) that Tripod Travels shall reserve at their absolute discretion for and on behalf of the Client for the purposes only of attending the Workshop as a group activity

Accommodation Provider shall mean any hotel, guesthouse, bed and breakfast or other form of accommodation deemed appropriate by Tripod Travels for the purposes of the Client attending the Workshop

the Workshop shall mean; any place, event or location together with such other details as may be recorded on the Booking Form to include accommodation and all photography tuition from Tripod Travels provided within the Dates.

 

AGREEMENT

The Booking Form and these Terms and Conditions shall form the entire agreement between the parties save for any variations agreed in accordance with these Terms and Conditions and no variation or modification shall be effective unless accepted by Tripod Travels in writing.

DEPOSIT

A Deposit is required when the client signs and returns the Booking Form in order to reserve a place on the Workshop for the Dates. The Deposit will apply towards the Fee payable for the Workshop listed in the Booking Form.

PAYMENTS

The balance of the Fee must be paid in cleared funds to Tripod Travels no later than one calendar month prior to the commencement Date of the Workshop. The Client shall always remain liable to Tripod Travels for the Fee and irrespective of any third party who may in whole or in part pay any element of the Fee on behalf of the Client. Any bank or Paypal charges incurred due to returned cheques or Paypal fees will be debited to the Client and payable in addition to the Fee.

NON-AGENCY

 

Nothing contained in this Agreement or the performance thereof is intended to or shall be construed to create any relationship of agency, partnership or joint venture between Tripod Travels and the Client.

 

CANCELLATION

Cancellation of the Client’s place on the Workshop must be notified in writing to Tripod Travels. 

In the event of the Client cancelling their attendance on the Workshop Tripod Travels reserves the right to charge an administration/cancellation fee of £60 and handle the Deposit as follows:

where cancellation takes place more than three months prior to the Dates the Deposit may be returned to the Client less a fee of £60 and less any hotel reservation fees incurred by Tripod Travels on behalf of the Client that are non-refundable.

where the Client makes a cancellation within three months of the Dates and where Tripod Travels are unable to fill the Client's place with another client paying the same Fee the Deposit shall be retained by Tripod Travels in full.

where cancellation takes place within one month of the Dates and Tripod Travels are unable to fill the Client's place with another Client paying the same Fee the Deposit shall be retained and any balance outstanding in respect of the Fee for the Workshop will become immediately payable by the Client to Tripod Travels.

 

In the event that the Client wishes to cancel the Workshop and attend an alternative workshop then at the absolute discretion of Tripod Travels and subject to availability the Deposit may be applied to an alternative workshop subject to an administration fee of £60 and any other costs incurred by Tripod Travels on the Client’s behalf.

 

WEATHER AND OTHER ADVERSE CIRCUMSTANCES

Weather permitting the Workshop will take place in and around the locations described in the Booking Form. In the event of any adverse circumstances or inclement weather Tripod Travels, in co-operation with all the Clients attending the Workshop, will make the necessary changes to the Workshop schedule taking into consideration health and safety risk assessments of any relevant situation and will take all reasonable steps to provide the Workshop within the Dates. Tripod Travels cannot be held responsible for the lack of photographic coverage caused by any adverse weather or other adverse circumstances that may restrict access to outdoor locations.

COVERAGE

Tripod Travels cannot be held responsible for the lack of photographic coverage caused by any restrictions in force by officials of any location where the Workshop is due to take place. Tripod Travels does not guarantee any specific photographs or to include any specific person background, location, props, or arrangement, although every effort will be made to deliver the Workshop in accordance with the Booking Form.

 

SCOPE OF THE WORKSHOP

The Tour Leader will take all reasonable steps to ensure the Clients remain together as a group for the purposes of safety and the running of the Workshop as a group activity.  Provided the Client remains within proximity to the Tour Leader (and not out of sight) the Client shall remain a part of the Workshop.  Where the Client decides to move away from the Tour Leader they will no longer fall within the scope of the Workshop and they will be entirely responsible for themselves, their actions and their own safety.

TRAVEL AND ACCOMMODATION

The Fee does not cover any costs associated with the Workshop beyond accommodation, and inclusive transport and all photographic tuition during the Workshop. All other costs and expenses associated with attending the Workshop are the responsibility of the Client.

The Client hereby authorises Tripod Travels to reserve Accommodation on the Client’s behalf for the duration of the Workshop and pay any sum due in respect of a deposit and any final balance due and the Client hereby indemnifies Tripod Travels against any loss in respect of any sum paid on the Client’s behalf in respect of any Accommodation costs.

 

The Client hereby acknowledges that a deposit paid on their behalf in respect of Accommodation may be non-refundable and/or subject to cancellation penalties charged by the Accommodation Provider.

 

In the event that the Accommodation is no longer available for any reason Tripod Travels will use reasonable endeavours to recover any sum paid on the Clients behalf in respect of their Accommodation.

 

FORCE MAJEURE

Force majeure is unusual and unforeseeable circumstances beyond our control, such as war or the threat of war, riots, terrorist activity, civil strife, industrial disputes, viral pandemics, natural or nuclear disaster, fire, flood or adverse weather conditions.

 

Tripod Travels does not accept liability for any loss or additional expense caused by delay or interruption to travel services or any aspect of the Workshop through weather conditions, civil disturbance, industrial action, viral pandemic, strikes, wars, floods or sickness. Such losses or additional expenses are the responsibility of the Client.

 

Whilst every care is taken to provide the Workshop on the Dates, it is subject to alteration or cancellation by Tripod Travels owing to any cause/s beyond its reasonable control.

CANCELLATION BY TRIPOD TRAVELS

Cancellation of the Workshop by Tripod Travels shall be noticed to the Client using the correspondence email address used between Tripod Travels and the Client in the course of enquiring and booking onto the Workshop.

In the event of cancellation by Tripod Travels, Tripod Travels’ liability shall be limited to a full refund of any sums paid by the Client in respect of the Workshop. A rearrangement onto a future Workshop can be arranged free of charge. Tripod Travels will not be responsible for any further costs, losses, claims or actions howsoever arising, and the Client hereby indemnifies Tripod Travels against same.

ILLNESS AND NON ATTENDANCE

Tripod Travels will use all reasonable endeavours to ensure that the agreed number of photographers are available for each Workshop; however, in the unlikely event that one cannot attend to undertake the Workshop, the Workshop may proceed with one photographer and without reduction of the Fee.

For all bookings made until further notice, in the case of the client contracting Covid19 or displaying or being required to self-isolate, deposits will be refundable subject to any deduction in respect of any payments made in respect of any Accommodation reserved on the Clients behalf and an administration fee of £40.

 

GOVERNING LAW

This agreement shall in all respects be governed by the law of England and Wales and the parties hereto submit to this jurisdiction.

INSURANCE

The Client hereby accepts sole responsibility to take out suitable insurance policy cover for any claims, expenses, losses, injuries, death, belongings, equipment, cancellation for any reason, any event or matter relating to or dependent upon the Workshop or actions of any kind arising in connection with (but without limitation) to the Workshop.

LIABILITY

Tripod Travels does not accept any liability for any losses of any kind whatsoever and however caused arising out of or in connection with the Workshop and the client hereby indemnifies Tripod Travels against any claims, costs, losses or demands howsoever arising in this respect.  Nothing in this clause shall seek to exclude liability for personal injury or death resulting from negligence.

INSURANCE ACCIDENT INJURY DAMAGE AND LOSS 

As the Client and participant in a Workshop it is your sole responsibility to ensure you, your belongings and equipment are adequately insured against injury, death and accident, accidental damage, loss, and theft, during the Workshop.

The Client herby accepts sole responsibility for ensuring that they have adequate insurance cover for life, medical and accidental risks before, during or after the Workshop. This insurance should cover the Client in the event of medical rescue and/or repatriation costs (in the case of accident or illness). All personal belongings (luggage) and equipment remain the sole responsibility at all times of the Client.

Tripod Travels cannot accept any liability for loss or damage to the Client or their equipment and the Client takes part in the Workshop entirely at their own risk.

It is the responsibility of the Client to ensure that they take heed of any instruction and/or advice given by Tripod Travels and should the Client select any locations or take any route to a location of their own choosing or move away from close proximity to where Tripod Travels are they do so in their own independent and individual capacity and entirely at their own risk and will be deemed to be outside of the scope of the Workshop and no longer a part of the Workshop until such time as they return to within close proximity of Tripod Travels such proximity to be within ear shot and eye sight of Tripod Travels.

Tripod Travels accepts responsibility for acts and /or omissions of its photographers (whilst acting in the course of their employment). Tripod Travels does not accept responsibility or liability for death, bodily injury or illness caused to the client or any other person included on the booking form, unless arising from the negligent act and/or omission of Tripod Travels (whilst acting in the course of their duties during the Workshop). 

 

Please note that suitably qualified medical personnel do not accompany any Tripod Travels Workshop and the Workshop will involve travel to remote locations away from immediate medical assistance. Tripod Travels is not equipped or trained to deal with a medical emergency or to provide care and assistance in the event of an emergency. In the event of a medical emergency affecting any Client at any time, Tripod Travels will endeavour to provide any practical assistance it can to assist the Client.

 

DECLARATION

In signing the Booking Form the Client hereby agrees and confirms that they have read and understood the content, meaning and effect of these Terms and Conditions and acknowledges that they have been afforded the opportunity of seeking their own separate and independent advice prior to doing so.
